Terms and Conditions:

Please read carefully as your acknowledgement is requested multiple times throughout the contract.

1. Session Fee: The Session Fee is due upon booking/calendaring your session, and is non-refundable. Session fee includes the initial consultation, where we will discuss location, wardrobe and colors, the session set-up, use of props, including maternity gowns, children’s clothing, newborn knits, the options of purchasing high-resolution edited images in an online gallery, digital download, or purchased products. Fees are set to cover the photographer’s time and artistic editing and the delivery of purchased products. Note: Photographer will not begin design work or process orders until payment is complete.

Session Fee does NOT include any gallery prints, digitals or products. Fees are subject to change at any time.

Forms of payment: Cash, PayPal, Zelle and Venmo are accepted. We do not accept personal checks.

2. Travel and Additional Fees: The client is responsible for covering additional fees and costs related to location choice (admission fees, parking, etc.). Travel up to 25 miles from 94509 is included, at no cost. There is an additional travel fee for any location outside the 25-mile radius from 94509. Time and travel beyond this, will be invoiced (contact me for pricing).

3. Digital Images: If the client purchases the digital download of images, Forever Young Photography Studios will provide detailed printing instructions. To ensure the best print quality, DO NOT ALTER the images before printing. The photographer is not responsible for printing errors or for quality of print or products ordered through the gallery as those vendors are 3rd party partners. 

4. Liability: Client is aware that the quality of the end result print of the digital files delivered is not under the control of the photographer and frees the photographer from any liability for any claims whatsoever based upon discoloration in the end result print. The photographer is not responsible for the quality of services provided by its business partners. Your purchase of any original files will release the photographer from any liability due to loss or damage to the photos. Additionally, the photographer is not responsible for any issues occurring during the printing process of the images, and we cannot guarantee the quality of the prints provided by is 3rd party business partners.

5. Cancellation: In the event of illness, please call as soon as possible to reschedule. Forever Young Photography Studios maintains the right to reschedule if needed due to weather, illness, emergency, etc. Requests for rescheduling are granted only at the photographer’s discretion.

6. Electronic Devices: While your session is taking place, you or your guest, attending the session, may NOT use a cell phone, personal camera or camcorder to take behind the scene shots or record any part of your session.

The photographer can and will stop the session and terminate the session if you or others use any of the above devices to take photos/videos at any time during the session taking place.

By signing below, you have read and agree you and/or others with you, will not take photos or videos at any time during the session.

7. Studio Etiquette/Responsibility: Children under 12, MUST be supervised at all times during the photo session. Children are NOT allowed on the studio props or allowed to handle any of the studio equipment unless instructed by the photographer. If at any time during the session, any damage due to accident/negligence of client, child or their guest, client will be responsible for replacement, repair, to the studio, props, or any equipment, including maternity gowns that are the property of Forever Young Photography Studios.

8. Late Policy: If you are late for your session, extra time will not be allotted for. It takes a certain amount of time for us to prep before and after each session in order for us to follow CDC Guidelines.  We are currently scheduling three (3) sessions on weekends, back-to-back, on Saturdays and Sundays.  During the holidays, you may have to wait in your car until we are ready for you as the holiday sessions are 5 sessions, back-to-back.

9. Reshoots: Reshoots and refunds WILL NOT BE GIVEN for poor choices in clothing, makeup, hair, or the lack of cooperation of subject(s), more specifically, young children.  If at any time during the session, more specifically a maternity session, the subject begins to feel ill, dizzy, faint, nausea, the session will end immediately and considered complete if the photographer is able to provide five (5) digital images required to complete a package even if there was only time for one backdrop or only photos taken in one gown. 

By signing below, you acknowledge that you have fully read and understand the Terms and Conditions of Forever Young Photography Studios.

10. Payment: The photographer will not begin design work or process order until payment is complete.

Portrait Policies

11. Deliverables: Photographer has a turnaround time of 2 to 4 weeks to deliver edited images, unless agreed upon otherwise, and stated in this contract. Once edited images have been completed, the turnaround for final products can be up to an additional 2 to 4 weeks.

12. Modifications: Images are not to be altered in any way. This includes any cell phone and social media filters, software or cropping. If you desire such alternations to an image, please let the photographer know when you place your order. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.) but more involved requests are billed at $35.00/hr. The photographer will let you know if there will be extra charges before work begins. Once the photographer and client come to terms on the additional/particular edits, the fee will be charged at that time which is non-refundable regardless of whether the final product is purchased.

13. Order or Reorder: You may order or reorder prints of any photos within one (1) year of the original session. After the one year, the photographer has no further obligation to retain any photos or retrieve any photos for re-printing and reserves the right to charge an archive retrieval fee to print any additional photos that have been retained after that period of time.

14. Copyright and Print Release: Forever Young Photography Studios retains copyrights to any and all images. Client receives printing rights. All digital negatives, digital files, and image proofs, even those purchased digitally, or on a USB (collectively, the "Photos"), belong solely to Forever Young Photography Studios. As such, you understand and agree that the photographer reserves the right to use the images for advertising, public display, publication, or other purposes without limitation and without any liability or obligation to you. Negatives, digital files and previews remain the exclusive property of the photographer. Under no circumstances, can a client use these images for profit, commercial endeavors, professional display, or in competitions. Copying or scanning images from the client's gallery, Forever Young Photography Studios website, or blog, is considered stealing, regardless of the intent for use.

NOTICE OF COPYRIGHT: It is ILLEGAL re redistribute these photographs for profit or use other than private consumption without the photographer's written permission, and violators of this Federal Law will be subject to its civil and criminal penalties.

Any unedited images are not available, under any circumstance, for purchase.

Images in the purchased package are carefully selected by the photographer. Clients receive only the number of images offered in the session package purchased. You may upgrade your package to include more images, but we cannot exchange a purchased image for a different image, once the package has been purchased.

By signing below, you acknowledge that you have fully read and understand Forever Young Photography Studios’ Photo Release and Copyright policy.

15.  Sneak Peeks:  Forever Young Photography Studios has my permission to use my or my child’s portraits publicly.  I understand that the images may be used on Forever Young Photography Studios's website and social media.  I also understand that no royalty, fee or other compensation shall become payable to me by reason of such use.

16.  Sharing/Social Media:  Any and all images shared on any social media channels such as Facebook, Instagram, TikTok, Twitter, etc. from a Model Call Session are to be posted with the photographer's logo, unless agreed upon otherwise and stated in this contract.  Please be certain that this policy is communicated to family and friends sharing your images.

17.  Model Release:  The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persona included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use.

18. Policies Concerning COVID-19 and Illness:  With concerns surrounding COVID-19 and for the safety of everyone’s health, listed below are policies and precautionary measures that are implemented and must be followed by everyone coming to Forever Young Photography Studios.  

Please read this carefully in its entirety.

Due to COVID-19, if you or your child(ren) are feeling ill/sick or showing ANY signs of illness including, but not limited to, fever or chills, cough, shortness of breath, body aches, headache, loss of taste or smell, sore throat, runny nose or upset stomach, you MUST reschedule your session.  No exceptions.  If you are anyone in your family has been exposed to COVIV-19, you MUST reschedule your session.

(If you reschedule the sessions as a direct result of COVID-19 or exposure thereto, as a professional ONE time courtesy, your retainer fee/deposit will transfer to another date.  Any rescheduling after that ONE TIME courtesy, will require an additional retainer fee to be paid in advance of the new scheduled date.)

*Face masks are mandatory:  Wearing a face mask is for the protection of all parties, including you and your family as well as your photographer.  Your photographer is fully vaccinated for COVID-19, and will be wearing a mask for ALL studio sessions.

*We are limiting the number of guests attending your indoor session to one guest.  This does not include the child or other immediate family members who will be photographed, but particularly as to friends or family who will not photographed.

*I will implement the social distance (6 feet) with you and your guest at all times.

*Please remain in your vehicle until Carol notifies you it is safe to enter the studio after she has finished sanitizing the studio.

*Please sanitize your hands when you first enter the studio.  We will have hand sanitizer available for your use throughout the session and I will also be using hand sanitizer throughout your session.

 *In addition, the studio will take your temperature upon arrival.

 *If you do not have a face mask, we will provide you with a disposable face mask before entering the studio.

 *Please leave your shoes at the front door entryway.

Precautionary Measures:

•  Carol is being proactive with everyone’s health in mind.  The studio is excessively sanitized before and after each session.
•  No beverages or snacks will be provided so I ask that you kindly bring your snacks/water with you. 
•  Regular hand washing and sanitizing will be implemented throughout the session.
•  Maternity gowns, props and children clothing, including newborn knits provided by Forever Young Photography have been, and will continue to be, properly sanitized for your safety, including the guest sitting area.

By signing below, you acknowledge that you have fully read and understand Forever Young Photography’s procedures concerning Studio Sessions with regards to COVID-19 and illness.

Client Guidelines for Outdoor Sessions:

Due to COVID-19, if you or your child(ren) are feeling ill/sick or showing ANY signs of illness including, but not limited to, fever or chills, cough, shortness of breath, body aches, headache, loss of taste or smell, sore throat, runny nose or upset stomach, you MUST reschedule your session.  No exceptions.  If you are anyone in your family has been exposed to COVIV-19, you MUST reschedule your session. 

(If you reschedule the sessions as a direct result of COVID-19 or exposure thereto, as a professional ONE time courtesy, your retainer fee/deposit will transfer to another date.  Any rescheduling after that ONE TIME courtesy, will require an additional retainer fee to be paid in advance of the new scheduled date.)

*Please limit the number of guests attending your outdoor photo session.  This does not include the child or other immediate family members who will be photographed, but as to friends or family who will not photographed.

 *All props used and fabrics are also deeply sanitized.

 *Carol and her assistant will stay socially distant.

 By signing below, you acknowledge that you have fully read and understand Forever Young Photography’s procedures concerning Outdoor Sessions with regards to COVID-19 and illness.

Newborn Sessions:  A typical newborn session lasts up to 4 hours.  Any session exceeding beyond the 4 hour, will include an additional fee of $50 an hour.  The photographer must complete her typical workflow before attempting any special requests from client.  If it is determined by the photographer that your newborn sessions needs to be rescheduled with the first 45 minutes of your session due to your newborn not cooperating, the photographer will reschedule your newborn session at no extra charge.  Rescheduling the session is left to the discretion of the photographer.  IT IS STRONGLY ADVISED that you have a pacifier accessible for the session even if you don't intend on using one on a regular basis.

Model Call Sessions:  Model Call Sessions include 3 digital images with the options to purchase more. The completion of all special requests are left to the discretion of the photographer.  

STUDIO POLICIES AND LIABILITY DISCLAIMER:  I take full responsibility in moving forward with my scheduled session and am aware of the risks involved.  

FAILURE TO PERFORM.  If the photographer is unable to perform tis agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the photographer, the photographer and client shall make every attempt to reschedule the session.  If a rescheduled date and time is unable to be agreed upon, photographer shall return the retainer to the client and shall have no further liability.  Further, if the photographer is unable to deliver photographic materials due to the technological malfunctions, including but not limited to camera and processing, or otherwise lost or damages without fault of the photographer, a replacement appointment session will take place.

IF THE PHOTOGRAPHER cannot fulfill this contract due to fire or other casualty, strike, act of God or other cause beyond the control of the parties, or due to the photographer's illness or emergency, then the photographer shall return any deposit or sitting fee to the client, but shall have no further liability with respect to the contract.  This limitation on liability shall also apply in the even that photographic materials are  damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer.  Int he event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client's order.  the client releases Carol Young, and all employees or affiliates of Forever Young Photography, from any and all liabilities, claims and damages that may result from any accidents or incidents that may happen during the session.

ALL IMAGES are copyright under the Federal Copyright Laws and subject to fines of up to $150,000 if breaking those law.  By signing this contract, you are agreeing not to copy, save, or reproduce images in any way.  This includes copying and saving images from the website, blog, Facebook, or any other form of advertisement.

I HAVE READ the studio policies above and I waive my rights to seek damages, compensations and/or any claim against Forever Young Photography Studios or its affiliates, employees, or studio.  

I FURTHER UNDERSTAND this agreement, including the terms and conditions, and agree to be bound to them.
